Material Safety Data Sheet (MSDS)

Material Safety Data Sheet (MSDS) Federal and Texas Law set out requirements for providing information on hazardous chemicals. The statutes and regulations require any employer who purchases or uses hazardous chemicals to comply by providing specified information about the chemicals to employees and to other employers who purchase or use the products. However, the regulations provide that “articles” are exempt from the hazard communication requirements. “Articles” are defined as “a manufactured item: (A) that is formed to a specific shape or design during manufacture, (B) that has end-use functions dependent in whole or in part upon its shape or design during end use; and (C) that does not release, or otherwise result in exposure to, a hazardous chemical under normal conditions of use.” TEXAS HEALTH & SAFETY CODE 502.003(1). Thus, employers who manufacture “articles” are not required to provide a Material Safety Data Sheet on their products. Texas Stone Designs’ products meet the definitions, both federal and state, of “articles”. It is not required therefore to provide an MSDS on our products.
